Obama's No Child Left Behind PACKAGES Waiver In Exchange For Evaluations Of Teachers, Standards: Chris Christie's 2012 re-RunStates who wish to leave specific No Child Left Behind legislation is to adjust to four different administrative reform laws that reflect the priorities of President Barack Obama announced Friday morning. "To help states, districts and schools that are ready to move forward in education reform, our government gives flexibility to the law in exchange for a real commitment to change," Obama said in a statement released by the White House on Thursday. "It is not intended to give states and districts respite from responsibility, but to release the energy to improve our schools locally." On Thursday, the White House circulated materials explaining that the administration will offer a "flexibility package." The No Child Left Behind law, passed by Congress a decade ago during the George W. Bush administration, requires regular standardized testing and the disaggregation of educational data by subgroup. It also states that just about 100 percent of students must reach proficiency in math and reading by 2014. As the deadline has approached, an increasing number of schools in each state have been labeled as "failing" under No Child Left Behind, in part because the reporting model focuses on raw scores, not improvement in scores. "Failing" schools face escalating consequences. States such as Montana and Idaho have resisted the ever-increasing performance targets, saying the law strains their capacities and leads to an overly broad portrayal of schools as underperforming. In light of those concerns, a White House fact sheet stated, the administration will allow states to request "flexibility through waivers of specific provisions" of No Child Left Behind, including the timeline for proficiency; "flexibility regarding school improvement and accountability requirements," which will allow states to set their own consequences for so-called failing schools; and "flexibility related to the use of federal education funds." Rural districts will have more freedom. A state that requests these waivers, the fact sheet said, will have to show that: It has already "adopted college- and career-ready standards in reading/language arts and mathematics" and administer "tests aligned" with these standards. The fact sheet does not detail what exactly such standards would entail, although U.S. Secretary of Education Arne Duncan has previously said states that haven't adapted the Common Core State Standards will not be barred from requesting waivers. It has set systems "of differentiated recognition, accountability and support," which includes turnaround plans targeted at the lowest 5 percent of the states' schools. It is "evaluating and supporting teacher and principal effectiveness" with a process that includes educator input. A senior administration official said on a conference call that this process must consider test scores. Beyond that, few details are available about the plan, such as the amount of funding over which states will have more discretion and the turnaround models that failing schools will have to use. No Child Left Behind has been up for renewal since 2007, and the administration released its own blueprint for the law in March 2010. But congressional gridlock has prevented formal reauthorization so far. Both Republicans and Democrats have introduced small components of a reauthorization -- with one measure involving charter schools passing last week -- but few have gained traction. In August, Secretary of Education Arne Duncan said Obama had approved plans to, in effect, reform the law without going through Congress: The secretary would waive specific provisions of the law in exchange for states agreeing to adopt favored reforms. Under No Child Left Behind, the Secretary of Education may waive provisions of the law for states in need, but he has no explicit authority to ask states to adopt reforms in exchange. The expanded waiver process is the administration's attempt to implement its own reforms, and the process comes with political risk. "The GOP is trying to develop a theme that Obama is overreaching in terms of federal power," said Jack Jennings, who heads the Center on Education Policy. "That's the argument they're using with the health care bill and the financial institution regulations. Now they're going to use it in education. [The administration is] playing into the narrative, and they know it." Already, GOP congressmen are criticizing the plan. In a floor speech Thursday, former Education Secretary and current Sen. Lamar Alexander (R-Tenn.) urged Duncan to "show restraint" with waivers. "Just because the secretary has every state over a barrel doesn't mean he should be tempted to use this opportunity to become a national school board," said Alexander. Rep. John Kline (R-Minn.), who chairs the House education committee, said in a statement that he "simply cannot support a process that grants the Secretary of Education sweeping authority to handpick winners and losers." On the other hand, a statement from Sen. Tom Harkin (D-Iowa) called the waivers the "best temporary solution." Harkin oversees the Senate committee responsible for the bipartisan mockup of a reauthorization bill. The NFL Suspended Three Games, Cedric Benson:Bengals running back Cedric Benson said through a team spokesman that he has not been informed of a three-game suspension. Mike Silver of Yahoo! Sports reported earlier in the day that Benson would be suspended starting with next Sunday’s game against Buffalo. The suspension would also cover the Oct. 9 game at Jacksonville and Oct. 16 home game against Indianapolis. There is an appeal hearing scheduled for Tuesday, which means he would be eligible to play in Sunday’s contest against San Francisco. Benson was charged with assault of a former roommate on July 16, which occurred during the lockout. He served time three weeks ago for an assault charge related to a 2010 incident outside an Austin, Texas, bar. Benson had a meeting with Commissioner Roger Goodell last year about the Austin bar incident and did not suspend him at that time. While this will affect revenue in the quarter, according to the company’s chief financial officer, the company expects to deliver its projected earnings per share this quarter. Law And Order:SVU Premiere/ New hires & old wound: Focus on the next season, "Law & Order: SVU" has had people who come to the show. But to a large extent, on Wednesday, "September 21", the main objective was the guy who is gone. Exhibition brings together more or less in real time, after the end of last season. So what about the newbies? With Stabler's fate not resolved until episode's end, we won't see Danny Pino until next week. But early indications are that Giddish might fit in OK. Rollins came on a little too Brenda Johnson in "The Closer" at first, but after that slightly awkward introduction she proved to be a fairly canny detective, albeit a little green. “Also, it felt like Munch and Fin got more screen time than they have in quite a while. That's not a bad thing. "It was also nice to see that Stephanie March ADA Alex Cabot," she and Diane Neal will both be around this season. "We are so confident Linus Roache now an office manager in the prosecutor's office. After a series of heavy industry, HP has become a sort of train wreck in recent years, the company has tried a number of wild, new strategies, but few of them have ended up. Most of those strategies have come under the guidance of Apotheker, who was originally hired on to save the company from the trouble it was put in by Mark Hurd, the prior CEO. Hurd was at the helm of what was perhaps the company's biggest scandal, when it was accused of illegally phone-tapping analysts and journalists. Apotheker was supposed to be the savior that prevented HP from sliding down that slippery slope. Instead, under his watch, the company's stock price has dipped 47%. The HP board is now reportedly discussing the possibility of ousting Apotheker from the company. Investors are becoming frustrated with the way HP is heading, andIt was of course under the leadership of Apotheker that HP purchased the failured of a company that was Palm. It was several months before HP was able to do something with the Palm operating system webOS, and once he did, was a disaster. Sales of HP Touchpad pills were so sad that in a matter of weeks, the price dropped to $ 99 just to get rid of inventories. So there is little reason to trust now Apotheker. The Blaine Gabbert: As reported last night, Blaine Gabbert is now Jacksonville Jaguars starting quarterback. Jaguar went to Luke McCown to start the season, because they knew they could control the game while the offense Gabbert collected more part-time, but after listening to McCown threw four against the Jets in New York and was on the bench in favor of rookie had to move. That being said, sooner than later I feel the Jaguars should open up the offense. Let Gabbert do what is comfortable, throw the ball from 3 + scale attack like the shotgun. He will be able to pass the ball in the center? Absolutely, but the modern NFL, is more than hunting, so it has become more friendly to the quarterback, who comes from a spread of transition to college. The team lack of effective weapons in the future of the game, but they have the tools to work with. When Marcedes Lewis is healthy, he's a great weapon in the passing game because he can line up anywhere and the defense can't pinpoint what he's doing. He can line up on the line of scrimmage and run/pass block, or run a route. That's Lewis' biggest asset, is the defense cannot single out what he's doing, he doesn't have a "tell". The team also has the "potential" of Zach Miller as a match up nightmare as a flex tight end. Mike Thomas is a good safety outlet, who's already been targeted in the passing game four times as much as the next receiver. Outside of that, the team leaves a lot to be desired however, which is why they'll need to line up wide and create natural spacing for their receivers to allow Gabbert room to work. "Reality TV star, who had shown poor performance has since improved slightly in the last two weeks has been voted off the competition on Tuesday, May 3. Baldwin Emmys After Hacking Vetoed Joke LOS ANGELES Leonard Nimoy in the last minute to Alec Baldwin in the Emmy Awards opening due to a flap over a joke about piracy News Corp. phone scandal. Alec Baldwin had saved the segment by playing a fictional president of the Academy of TV-based Jane Lynch. However, Baldwin called when Fox refused to let the joke referred to the hacking scandal involving British tabloid News of the World has closed. Both Fox and News of the World are owned by News Corp. Fox said the network believed it was inappropriate to make light of an issue being taken seriously by the company. The joke reportedly involved Baldwin on a telephone and saying, "Is that you, Rupert?" a reference to News Corp. boss Rupert Murdoch, suggesting he was listening in on the conversation. Baldwin was not at the Emmys because of a previous commitment to attend Tony Bennett's birthday party in New York. He tweeted that Fox killed the joke, "which sucks because I think it would have made them look better." He also tweeted: "If I were enmeshed in a scandal where I hack the phone of families of innocent crime victims purely 4 profit, I'd want that 2 go away, 2." Miami Hurricanes and Ohio St Buckeyes College Football Betting Predictions: A lot of the luster was taken off this match-up by some off the field issues for both teams that led to suspensions of key players on both sides. In fact, some people are sarcastically calling this the “Ineligi-Bowl.” Ohio St has definitely been hit the hardest by the scandals so far as former coach Jim Tressel was forced to resign and quarterback Terrelle Pryor left the program when additional violations surfaced that would have cost him his eligibility. Both were originally suspended for the first 5 games of this season along with several other key Buckeye players. Miami has their own problems as former booster Nevin Shapiro, a convicted felon, admitted he gave improper benefits to Hurricane players since the early ’90′s, including to 8 current Miami players. The university and the NCAA gave the 8 players staggered suspensions. Five players were suspended for the season opener against Maryland, including quarterbacks Jacory Harris, but will return this week after the Hurricanes had a bye last week. Four other Hurricane players are suspended until at least October. Ohio St, under interim coach Luke Fickell, has weathered the storm so far with 2 wins over Akron 42-0 and Toledo 27-22. Now the #17 Buckeyes go on the road for the first time as the take on the 0-1 Hurricanes. Miami, under first year coach Al Golden, lost 32-24 at Maryland to open the season. Ohio St and Miami are playing for the 5th time in history. Ohio St leads the series officially 2-1 as last year’s 36-24 win in Columbus was vacated by the university. The two schools played a memorable game in the 2003 National Championship with Ohio St winning 31-24 in double overtime. Coming into last week’s game against the Toledo Rockets, Ohio St hadn’t lost to another team from Ohio since 1921. That streak almost came to a crashing halt as Toledo took a 22-21 lead early in the fourth quarter. The Buckeyes scored with 3:17 to go and then held the Rockets to avoid the upset and survive 27-22. The Buckeyes had only 301 total yards including 112 rushing yards. They had 17 first downs and were 3/13 on third and fourth downs. Ohio St held Toledo to 338 total yards including 46 rushing yards. The Rockets had 14 penalties and a turnover and still almost pulled off the upset. Toledo had 16 first downs and was 6/21 on third and fourth down conversions. Ohio St is averaging 409 total yards and 34.5 points a game. The Buckeyes are averaging 241 passing yards a game. Ohio St has 2 turnovers and no sacks. The Buckeyes are 12/30 on third and fourth down conversions. Ohio St is 0/2 on field goals this year. The Buckeyes are allowing 214 yards a game on defense and 11 points. They are allowing only 40.5 rushing yards a game. They have forced 2 turnovers and 9 sacks a game. Buckeye opponents are 9/35 on third and fourth down conversions. Buckeye quarterback Joe Bauserman has done well this season. He is 28/46 passing with 352 passing yards, 4 touchdowns, and no interceptions. He also has 8 carries for 39 yards and a touchdown. Running back Carlos Hyde 39 carries for 169 yards, and 2 touchdowns, along with 5 catches for 39 yards. Rod Smith has 25 carries for 98 yards and a touchdown. Receiver Devin Smith has 5 catches for 119 yards and a touchdown. Jake Stoneburner had 8 catches for 93 yards and 4 touchdowns. Kicker Drew Basil is 9/9 on extra points but 0/2 on field goals. Three Buckeye players return from a 2 game suspensions for this game including OL Corey Linsley, RB Jordan Hall, and DB Travis Howard. However, Rb Dan Herron, WR Devier Posey, OL Mike Adams, and DE Solomon Thomas won’t return until October 8. Despite the suspensions Miami took a 24-23 lead with 4 minutes to go in the game against Maryland. Maryland scored 9 points in the last 1:39 of the game to win 32-24. Miami had 367 total yards including 172 rushing yards. Ten penalties and 4 turnovers doomed the Hurricanes, including two defensive touchdowns. The last one occurred with 39 second left, a 54 yard interception return, allowed Maryland to cover the 4 point college football betting line. Miami had 18 first downs and was 7/16 on third and fourth down conversions. The Hurricanes allowed 499 total yards including 348 passing yards. Maryland had 28 first downs and was 8/16 on third and fourth down conversions. Quarterback Stephen Morris struggled as he replaced the suspended Jacory Harris. Morris was 19/28 passing with 195 yards and 2 interceptions with no touchdowns. He did have a rushing touchdown though. Harris returns for this game. Harris threw for 1,793 yards, 14 touchdowns and 15 interceptions, and added 2 rushing touchdowns as well last year. Running back Lamar Miller had 18 carries for 119 yards and a touchdown, along with 2 catches for 3 yards. Mike James had only 34 yards rushing but did have a rushing touchdown. Allen Hurns and Tommy Streeter each had 4 catches for the Hurricanes. Kicker Jake Wieclaw made all 3 extra points he tried along with a 30 yard field goal. Miami is 0-1 against the spread and the game went over the total. Ohio St is 1-1 ATS this season and both games went under. Ohio St is 18-6 ATS on Saturday in the last 3 seasons, 15-5 ATS with 6 days of rest in the same span, and 10-2 ATS in non-conference games in the last 3 seasons. The Buckeyes are 11-3 ATS in all games the last two seasons, including 9-1 on grass. Miami is 1-4 ATS in the last 5 as a favorite, as a favorite of less than 3 points, against a team with a winning record, in con-conference games, against Big Ten teams, and 1-5 in the last 6 on grass. Miami is 3-12 ATS in the last 15 games after a bye week. We don’t know how these teams will deal with the suspensions. Miami shot themselves in the foot two weeks ago with penalties and turnovers but should be better as they get 5 players back from suspension. Ohio St almost stumbled against Toledo last week. The Warren Zevon, 180 Gram Vinyl: Warren Zevon has been checked out of the Terran Hotel for nearly eight years now. Yet despite an at times callous neglect by the survivors back here on Earth, his recorded output has had numerous reevaluations, both before and after his death. With Rhino Records massive reissue campaign of the Elektra Asylum catalog on both double CD collections, complete with demos and bonus outtakes, and on high quality 180-gram vinyl, we’re able to take one more look at Zevon’s underrated material. I’m taking a look at his Asylum-issued, self-titled record today and asking myself how it wasn’t the enormous hit that it should have been. Warren Zevon is actually the singer’s second album. His first, Wanted Dead or Alive, hit the shelves in 1969, seven years before the follow-up and too little fanfare. What made his self-titled release different is that he was able to call upon the talents of numerous musicians with which he’d acquainted himself in his ten years in the music business. Chief among them is the record’s producer, Jackson Browne, and he’s followed closely by a who’s who of Los Angeles’ Mellow Mafia. Zevon had worked up a great deal of material and all of the songs on the record bear his name on the songwriting credits. While Zevon would become well known for his use of satire and the way he deployed it in biting political and social commentary, the songs here also contain autobiographical elements which must have required him to dig deeply in order to boldly lay his soul bare to the listener. In all, it’s a very strong piece of work and there are several moments which demand further discussion. Side 1’s “Mama Couldn’t Be Persuaded” is pure autobiography. It’s the tale of a family warning their daughter “don’t marry that gambling man” and how the daughter’s ignorance of the warning led to a chaotic and unsettled life for the daughter’s son with the gambler. You see, Zevon’s father was in fact a professional gambler. The need for a man with that kind of “job” to go where the action was hot and also flee to where the heat was not so hot caused the young Zevon’s family to relocate frequently. His parents did eventually divorce when Zevon was sixteen, but by then his formative years had already left him with a skewed worldview. To augment Zevon’s voice and piano on the song, Browne and JD Souther added harmony vocals, while Browne hired Waddy Wachtel for guitar duties and multi-instrumentalist David Lindley to play fiddle. Wachtel’s lines are especially funky and really serve the upbeat approach of what could have been a song wallowing in lament. Zevon’s casual display is just one example of how he fearlessly discussed any topic he felt was deserving of a good song. Side one closes with “The French Inhaler,” which discarded Lindley, Browne, and Souther in favor of harmony vocals delivered by Glenn Frey and Don Henley. Zevon’s almost baroque piano provides a mock elegance to this song discussing a woman who’s run out of luck and options in her pursuit of an acting career. Now reduced to a junkie/wino/prostitute, her persistent allure is celebrated by Zevon, even though he “drank up all the money” during their relationship. Though she’s sliding out the door of the bar straight into skid row, Zevon seems very aware that, for the turn of more fortunate cards, he could very easily be following right behind her. The song, like many from Zevon, seems to be the skeleton of a screenplay for a heart wrenching movie that’s yet to be filmed. Sweetening the dimly lit affair are the background vocals, which are as beautiful as any delivered by the duo while recording with The Eagles. Side 2 has its own surprises, including the seeming forecast called “I’ll Sleep When I’m dead.” Zevon is on piano once more and he’s also playing some wicked harmonica. He’s joined by Wachtel and the legendary Jim Kewskin Jug Band member Fritz Richmond on, what else, jug. Browne also employed renowned studio drummer Gary Mallaber (Eddie Money, Steve Miller, Van Morrison, and Bruce Springsteen) and longtime Zevon associate Jorge Calderon on harmony vocals. The song’s protagonist likes to “raise a little harm” while “drinking heartbreak motor oil and Bombay gin” as prescribed medicine. He’s describing himself of course, and the life he’d been leading which dictated the nickname F. Scott Fitzevon. He did escape the clutches of alcoholism later in life, but in the mid-70s he had no intention of slowing his pace and he was frank about that fact. “Join Me in L.A.,” a lyrically sparse piece, is Zevon’s praise to the city he called home at the time. With the singer switching to guitar on the song, Browne took up piano duties and left the harmony background vocals to Bonnie Raitt and Rosemary Butler. Legendary saxophonist Bobby Keys (misspelled as “Keyes” on the jacket), famous for his work with The Rolling Stones, Bobby Vee, Buddy Holly, The Who, Harry Nilsson, and Joe Cocker, among others, gives a fiery performance. The grande finale, “Desperadoes under the Eaves” followed; complete with a string section and lush harmony vocals by Carl Wilson, Browne, and a mysterious outfit called “The Gentlemen Boys” (my guess is this is really The Beach Boys). Zevon is drinking again and reflecting that California will slide into the ocean, but not until after he’s paid his bar tab. There’s a brilliant verse – “Don’t the sun look angry through the trees/Don’t the trees look like crucified thieves/Don’t you feel like desperadoes under the eaves/Heaven helps the one who leaves” –that serves as one more reminder that, despite the ugliness and loneliness, L.A. is where Zevon planned to stay until he was done in by either his drinking or the San Andreas Fault Line. Warren Zevon is a record that exemplifies all that was indicative of album rock and soft rock radio in 1976. Yet he’d have to wait for the follow-up, Excitable Boy, two years later to gain any success. He took more chances as his career continued, penning wilder lyrics and employing allegory to a greater degree. Although listeners didn’t embrace the record as expected, it’s not because Zevon lacked talent, identity, or bravery. He should have been famous right out of the starting blocks, but perhaps we remember him better as the man who stumbled first.

The ACC announced late Sunday morning that the Seminoles will take on Clemson in a 3:30 p.m. game at Clemson's Memorial Stadium. The game will be televised by ESPN. Last weekend, the conference announced it was putting that game under a six-day option, presumably to see what happened in the teams' big games this past Saturday.
